File:Elisa Gabrielli on Christmas Eve 2008.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.
If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues. |

Photo deleting and uploading
[edit]I see you tried to replace an image. To deal with it, we would need:
- A permission to use the image you uploaded, according to the page Commons:Permission. This image is going due to lack of permission.
- Any evidence that you (User:Juniper99) are the person in the picture. This could be done by the same e-mail sending permission.
Feel free to ask if you need help.--Pere prlpz (talk) 11:32, 30 January 2012 (UTC)
Hi!~ Thanks. I do need help. This is me, Elisa Gabrielli and the file I tried to upload to replace the other image is one of my official headshots. It is also on IMdB, my personal webste etc. Headshots, by their nature are taken, paid for and owned by the actor, in this case, me. I give full permission for it's use on Wikipedia. I went to the Commons Permission page but find it confusing as to which letters and brackets to use. forgive me , but I am pretty tech challenged to say the least.
All the best, Elisa ____
- Hi... thanks for responding. When it comes to photos which are available elsewhere on the web, particularly professional photographs, we are typically very careful about the copyright status -- people have sometimes gone to some lengths to make it appear uploads are legitimate when they really were not. This happens particularly with fans who want to see the professional photographs on the wikipedia articles ;-) Anyways, due to the uncertainty with anonymous uploads here, there is a separate system to confirm permission for such images, which consists of a private permissions email preferably sent from an email address which can be associated with you. The instructions are at Commons:OTRS, which includes sample content for the permission, and the address to send it to. The idea behind the email is to 1) confirm your identity, and 2) make sure you are completely aware of which rights you are licensing. Please note that we cannot accept permission for Wikipedia only; the idea behind the "free encyclopedia" (and particularly Wikimedia Commons, this project) is that the content is available for anyone to use on the same terms. This includes copying to other places, making derivative works, and even commercial use. Note that this does not require anything like a model release or imply anything regarding publicity rights; this is strictly about the copyright itself, which is usually owned by the photographer. Contracts with photographers in situations like these come in all shapes and sizes, but if you claim to have full rights over the photo, I think that would be enough with the OTRS email. The two most common licenses we use are CC-BY (Creative Commons Attribution), and CC-BY-SA (Creative Commons Attribution-ShareAlike). Both allow distribution, derivative works, and commercial use; they also both require anyone who uses them to include a credit line of your choice, and the Share-Alike also requires that any derivative works (for example modifications of the photo, or another graphic image which incorporates the photo) must also be licensed under the same "free" terms. You can read more about the licenses at http://creativecommons.org/licenses/#licenses and they have a page to choose a license here. Note that we cannot accept licenses which have "NC" (Non-Commercial) or "ND" (No Derivatives) parts. The credit line can be of your choosing -- you can just require "Elisa Gabrielli", or you can require credit to the photographer instead, or to include both names (per the IMDB page the photographer appears to be Stacie Isabella Turk). Any uses which violate the those terms are copyright violations, though of course, stuff on Wikipedia does tend to get copied a lot, and not everyone pays attention to the terms. Thanks again for responding, and an email confirming the license would definitely be appreciated, and resolve any issues. I can't guarantee that the other photograph will be deleted -- that is a separate issue -- but if the permission for your image is confirmed it would almost certainly be the primary photo used on any articles. It may also be preferable to upload with a new name, so it's not associated with that other photo at all. Carl Lindberg (talk) 17:33, 31 January 2012 (UTC)
