Critically evaluate Flickr licenses

File:GerardWay.jpg has been marked as a copyright violation. You may have preserved the information shown on Flickr correctly when transferring the image here, but the Flickr uploader is not the copyright holder of this image. Either the image was created by someone else, or it is a derivative of someone else's work. As stated in Commons:Licensing, only the copyright holder may issue a license, so the one shown on Flickr is invalid.
Always remember to critically evaluate Flickr licenses. Photostreams with professional-looking photographs, album covers, posters, and images in a wide range of styles or quality taken by many different cameras often indicate that the Flickr uploader either does not understand or does not care about copyright matters. See Commons:Questionable Flickr images for a list of known bad Flickr users.

http://www.flickr.com/photos/sand_akatsuki_girl_of_the_mist/3640327912/ is not the photographer of this file, so he/she can not give a free license that allows everyone to use the photo. It must be the photographers wish that everyone can use this image for every purpose including commercial use. Only if this wish is expressed you can upload something to Commons. I Wear The Mask Of No Emotion Well, Don't I? is NOT the owner of copyrights of this photo, just see the TinEye hits for this file http://tineye.com/search/53f835b68b08473069e9672e93306775fb01ce88. I Wear The Mask Of No Emotion Well, Don't I? simply copied this file from another website and dont care about, what a Creative Commons license means.
