Help: no-FoP Italy
Hi. When you have a moment, could you do me a favor. I decided to occupy my time to list the no-FoP files in Italy. It has been a long and difficult work that needs to be reviewed by administrators. No permission?
What is the basis for adding "no permission since" to File:Wikimania Haifa Yakudza.JPG? It is described as "own work" and the listed author is the uploader. This is probably the case for half of what is on Commons. What is different about this one? - Jmabel ! talk 16:57, 4 December 2012 (UTC)
- Author of photo (copyright holder) is the person who make photo, not the person who is pictured on the photo. Here was similar case (when 'author' of photo was pictured on that, and it was deleted).--Anatoliy (talk) 17:01, 4 December 2012 (UTC)
- Right, but there is much precedent in copyright law that the person with creative control of the image, and hence the copyright holder, is not necessarily the person who snapped the shutter. If I set up aperture settings, etc. for a photo, work out the composition, and use someone else as a "human tripod", I still own the copyright. How do you know that isn't what happened here? Has some second party raised an objection and claimed authorship rights? - Jmabel ! talk 00:13, 5 December 2012 (UTC)

- No, I don't suggest that. Perhaps I've been unclear. The photo was uploaded by a longstanding contributor who generally seems to know what he's doing, has (as far as I know) no history of fraudulent claims, and who states that he is the author. I was raising the possibility that someone else was claiming authorship because it was about the only clearly I could readily imagine that would raise an issue. If the only reason to doubt him is that he's in the photo, it seems odd to start with {{No permission since}} instead of with a direct question to him about the circumstances of the photo, since there are plenty of ways to be in a photo and still have authorship in the legal sense. (Heck, Cindy Sherman has made an entire career out of it.) "No permission since" effectively means you are disputing his claim of authorship, since if he is, indeed, the author the permission situation is entirely clear. - Jmabel ! talk 06:52, 5 December 2012 (UTC)
- hello, sorry for butting in, but i am really curious about the situation here. and it seems like there is no general recommendation about how to deal with the matter. dear Jmabel, and what have you expected ahonc to do? not to tag a picture and to contact the user, that's one thing. suppose ahonc did it, the user explained. they solved the problem and ahonc went back to his business. the user - back to his(or her). then, after a while, someone else would happen across the picture and ask the user or tag the picture itself... is there anything a user with such a 'suspicious' picture can do? maybe (s)he is to post some explanation on the talk page of the file? (in the description field?) i was asking if an otrs ticket can help, as otrs agents may deal with some confidential info, so maybe the author/holder of the rights can write one 'story' for them to keep in their records (and to have a yellow 'protection' ticket on the file)? --antanana 15:34, 5 December 2012 (UTC)

- that is one of the ways, i believe. but as no one has really doubted your authorship there, it's difficult to accept it as a universal method, it seems ;) of course, unless ahonc accepts it as 'the matter is solved, so off my talk page you both go' ;) --antanana 16:38, 5 December 2012 (UTC)

- Я могу с таким же успехом у себя на странице добавить ссылку на фейсбук. Вы сделайте наоборот: в профиле на фейсбуке добавьте линк на страницу в ВП. Тогда действительно будет доказательство, что это ваша страница. Альтернативный вариант: если вы автор фото, у вас должны остаться фото в большом разрешении (современные цифровые фотоаппараты дают ~3000 пкс по меньшей стороне). Вы можете загрузить эти фото, тогда не будет к ним претензий.--Anatoliy (talk) 20:32, 29 December 2012 (UTC)
