These images are NOT derivatives of copyrighted packaging and New York State Department of Health IS the copyright holder. No company owns the name Dank Vapes. Dank Vapes had no copyright holder when these pictures were taken because Dank Vapes was an illegal brand made by different fake companies engaging in illegal, criminal activity.[1][2] I noticed that there are no trademarks on any of the packages.

All of these images below were part of an investigation into people that were engaging in criminal conduct:

No explanation was made as to why these are thought to be derivatives of copyrighted packaging. On the contrary, there is no copyrighted content from these black market products. See "THC vaping products called Dank Vapes are linked to many of the cases of lung illnesses. The counterfeit brands have common packaging that is easily available online and used by distributors to market THC-containing cartridges."[3]
