Dear Sir,
I am a long term volunteer with Wikimedia Commons, the public repository of media that supports Wikipedia and similar projects with over 20 million educational and historic images.
We currently host some photographs taken by ICRC employees of captives at Guantanamo that were later released by the families of the captives. There is no verifiable public release on record by the ICRC of these images, an example is linked below where we are hosting the file based on a statement from a lawyer representing the family but not the ICRC.[1]
As our mission is to preserve images like this for the public benefit in the long term, and your website states that the default for images your provide is for non-commercial use unless explicit permission is granted [2], could you please provide a confirmation as to whether images specifically taken as part of your access to captives at Guantanamo can be considered officially released as public domain for the public benefit, or whether the ICRC wishes to retain the commercial rights to any publication or re-use of the photographs?
