[edit]現在、大量の市町村旗の画像がこのテンプレートを使ってPDとされていますが、ja:Wikipedia:井戸端/subj/都道府県旗のアップロードやCommons:井戸端/過去ログ3#都道府県旗及び都道府県章のアップロードは問題ないかの議論からして「日本国著作権法第十三条」を適用してしまうのは危険かと思われます。もちろん著作権が切れたものも多く、Template:PD-Japan-organizationへの変更が可能なものはそれでいいですが、著作権保護期間内のものはPDにはできません。ただし、簡単な図案は著作権の対象としないとする考えもありますので、投稿者の自己責任でTemplate:PD-ineligibleにするなら勝手です。異論・別案が無ければ、投稿者への呼びかけの後、一斉に除去してしまおうかと考えています。コモンズの流儀を知らないので反発があるかもしれませんが、より良い解決策があればご教示ください。--Knua (talk) 16:50, 6 March 2009 (UTC)
Now, many flag files of local government transclude this PD-Japan-exempt. But according to ja:Wikipedia:井戸端/subj/都道府県旗のアップロード and Commons:井戸端/過去ログ3#都道府県旗及び都道府県章のアップロードは問題ないか, flag is not apply "Article 13 of the Copyright Law of Japan".
Some (many) flag image which the copyright has expired can replace Template:PD-Japan-organization. Other flag image file must be replace this template. I will remove this template from flag image files after caution contributor. If contributor think flag image don't have copyright, this template may be replaced Template:PD-ineligible at contributor-responsibility.--Knua (talk) 16:50, 6 March 2009 (UTC)

- 法的な根拠はありませんが、ウィキペディア日本語版では自治体の旗をパブリックドメインとしてしまうにはリスクが高いという判断をもとにしています。この議論を踏まえてなおパブリックドメインと主張する場合、全面的に法的責任を投稿者が負うであろうということです。--Knua (talk) 16:12, 7 October 2009 (UTC)

- Wikisource link Copyright Act of Japan can be used instead, though direct link to Article 13 is not active. 'Template:PD-Japan-exempt/en' is only editable by admins, so one can request that.--Kyuri1449 (talk) 10:23, 4 April 2019 (UTC)
Discussion about the copyright of 'sho', Japanese calligraphy

(For your infromation) Summary, (1) Japanese court tends to regard 'sho', Japanese calligraphy, as a work of art, in condition the 'sho' is mainly the object of art appreciation. So such 'sho' is subject to copyright protection. (2) 'Template:PD-font', where rasterized expression (e.g.bitmap) by fonts and typefaces is not subject to copyright protection in US and Japan.(see Wikipedia:Public domain#Fonts), is not applicable to the 'sho' of 1 criteria. (3) 'Template:PD-Japan-exempt' is not applicable to the certain 'sho' of Reiwa era (令和) raised by Japan gov CCS Suga, because Japanese Copyright Act limits such exemption to 'laws, regulations, notifications, instructions, circular notices and judgments, decisions, orders and decrees of law courts, and translations or compilations of these'. While that US Copyright Act allows exemption very widely that 'a work prepared by an officer or employee of the federal government as part of that person's official duties' is put on PD. -Kyuri1449 (talk) 10:23, 4 April 2019 (UTC)

- @Foomin10: 英語版についてはウィキソース上の翻訳へのリンクに張り替えましたが（Special:Diff/658722631）、他の言語については翻訳されていませんでしたので、こちらについてはまだ編集していません。どこへのリンクが良いでしょうか。。。ちなみにWayback Machineには、確認できる限り最新のアーカイブがweb.archive.org/web/20120629133307/http://www.cric.or.jp/cric e/clj/cl2 1.htmlに残っていますので、こちらなんかはどうでしょう。--TKsdik8900 (talk) 08:41, 25 May 2022 (UTC)
