This photo is easily found all over the internet, not "Own work by uploader" really. But it might be OK in terms of copyright anyway. The photo may have been taken in the 20s really. So it depends upon where and under what legal system? One can find many copies using google image search: http://images.google.com/images?um=1&hl=en&client=safari&rls=en-us&q=王明&btnG=Search+Images
