About freedom of panorama in Lithuania

The amendment (XI-1833) says:
- Pakeisti 28 straipsnio 1 dalį ir ją išdėstyti taip:
- „1. Be kūrinio autoriaus ar kito šio kūrinio autorių teisių subjekto leidimo ir be autorinio atlyginimo, tačiau nurodžius, jei tai įmanoma, naudojamą šaltinį ir autoriaus vardą, leidžiama:
- 1) atgaminti ir viešai paskelbti architektūros kūrinius ir skulptūras, sukurtus nuolat stovėti viešosiose vietose, išskyrus atvejus, kai jie eksponuojami parodose ir muziejuose;
- 2) pastato ar kito statinio projektą, brėžinį, eskizą ar modelį panaudoti to pastato ar statinio rekonstrukcijai.“

The bold part clearly says that buildings that are in public can be publicised.
So where and how did Commons came up with the idea that buildings are not allowed to be reproduced in public?

"Freedom of panorama" Lietuvos pastatams

Nežinau ar teisingai kreipiuosi, sąrašą radau: https://lt.wikipedia.org/wiki/Vikipedija:Administratoriai
Pastebėjau kad Wikipedia masiškai trina nuotraukas iš Lietuvos nes neva nėra Commons:Freedom_of_panorama.
Pažiūrėjau ką Wikipedia (nežinau ar čia tas pats kaip WP Commons ar ne) rašo apie Freedom of panorama Lietuvoje – Commons:Copyright rules by territory/Lithuania. Atsiverčiau tuos įstatymus ir labai aiškiai parašyta kad pastatus fotografuoti ir nuotraukas platinti galima. Ką beje labai sėkmingai daro ir Lietuvos spauda, – pastatų nuotraukas viešina laisvai ir nereikia jokių sutikimų.
Tai kodėl Wikipedia nuomone Lietuvos pastatams nėra "freedom of panorama"?
Cituojami įstatymai kurie ryškiai leidžia fotografuoti pastatus?
Klaida pas Wikipedia ar kažko nesuprantu?

- Aktualu ir @BigHead (@Augustas Didžgalvis) kuris daro labai geras Lietuvos nuotraukas.
- Ir jo nuotraukos sudaro turbūt didelę dalį Wikipedia esančių nuotraukų apie Lietuvą.

- Lithuanian FoP is simply not suitable for Wikimedia Commons because only non-commercial uses are permitted. Such content is forbidden here, see COM:Licensing#Forbidden licenses. Educational-use-only is also not allowed. In fact, the permitted licenses – {{Cc-by-sa}} (1.0, 2.0 etc.) {{Cc-by}} (1.0, 2.0 etc.), {{Cc-zero}}, and/or {{PD-user}} – are commercial-type licenses that do not permit non-commercial-only restrictions. This makes the Lithuanian FoP provision not OK for Commons. Only incidentally-included works ("when the work is not the main subject") are allowed.
- Pending a reform to align the Lithuanian law to the Internet/new media age (where commercial uses in travel websites or professional photography cannot be prevented), your local Wikipedia (Lithuanian Wikipedia) may host limited number of images for informational and non-commercial uses only, if your local Wikipedia allows local uploads.

[edit]What was the copyright protection in Lithuania in 1996, i.e. on the URAA date? Was it life+70 like now or was it shorter, like life+50? I am asking as it affects of which works the copyright was restored by URAA. -- Jan Kameníček (talk) 10:17, 31 October 2024 (UTC)
