Indian signatures

[edit]

See Commons:Deletion requests/File:Manmohan Singh Signatures.svg. Lots of Indian signatures were deleted some time ago because there was significant doubt that {{PD-signature}} applies to Indian signatures. These signatures do not meet the age requirements in {{PD-India}}, so they may need to be deleted too. --Stefan4 (talk) 22:14, 1 August 2013 (UTC)[reply]

Comment: All of these images were listed at Possibly unfree files at the English Wikipedia and were deemed PD there. – Quadell (talk) 23:49, 1 August 2013 (UTC)[reply]
Follow up: a little research has lead me to understand that many signatures are eligible for copyright protection in the UK, whereas no court cases about the copyright eligibility of signatures are known to exist in India. – Quadell (talk) 23:55, 1 August 2013 (UTC)[reply]
The problem is that the Indian copyright law essentially is a copy of an old version of the British copyright law with minor modifications. See for example COM:FOP#India which has the same kinds of restrictions as COM:FOP#United Kingdom. The copyright terms in {{PD-India}} are essentially the ones from the British w:Copyright Act 1956 but extended by 10 years due to a change in the law in the 1990s. Other former British colonies also appear to use old copies of the British copyright law. As many other parts of the copyright laws are similar, the threshold of originality might also be similar (compare e.g. COM:TOO#United Kingdom with COM:TOO#Australia), and for this reason, lots of Indian signatures were deleted in Commons:Deletion requests/File:Manmohan Singh Signatures.svg. All signatures are, on the other hand, in the public domain in the United States, which means that any signature is free according to English Wikipedia which doesn't care about the copyright status in the source country (see w:Template:PD-ineligible-USonly). --Stefan4 (talk) 11:04, 2 August 2013 (UTC)[reply]
I see. If these are deleted here on Commons, do you think it would be appropriate for an admin to restore the files on en.wiki and tag them w:Template:PD-ineligible-USonly? – Quadell (talk) 12:02, 2 August 2013 (UTC)[reply]
Most of these are in use on English Wikipedia, and those should definitely be there if they can't be here. If deleted here, also consider tagging them with w:Template:Deleted on Commons. --Stefan4 (talk) 13:14, 2 August 2013 (UTC)[reply]
  • Delete. I am now convinced that these images cannot be considered PD in their country of origin. Once they are deleted here, I will restore them on the English Wikipedia (since they are PD in the US). – Quadell (talk) 12:04, 9 August 2013 (UTC)[reply]
