FoP-Sweden by User:Hangsna

As uploader and photographer I request this images to be deleted. On April 4, 2016 the Swedish supreme court ruled that FoP doesn't apply in Sweden when images are used in a database on the internet, therefore i request the files i uploaded to be deleted. Some files perhaps might be PD-old (and then could be kept) but its not that easy to find all dates so i rather nominate them all. /Hangsna (talk) 13:54, 5 April 2016 (UTC)[reply]

 Keep For the time being until there is a Commons standpoint. The ruling was about making photographs of copyrighted material available to the general public via the Internet. This is about the distributor, not about the photographer and probably not about the uploader. The decision should be made by Commons or the WMF. Edaen (talk) 14:09, 5 April 2016 (UTC)[reply]

 Keep There are no verdict yet. The lower court "Tingsrätten" asked the supreme court "Högsta domstolen" to interpret the law and so it did yesterday. But now we must wait for the verdict from Tingsrätten and see how far it goes and if Wikimedia Sverige will appeal. /Rrohdin (talk) 18:14, 5 April 2016 (UTC)[reply]

 Keep Agree with Edaen and Rrohdin. This is not finally decided yet and there are discussions going on among lawyers in Sweden what the decision actually means for the photographers. WMF's lawyers are also looking into this.--Historiker (talk) 18:58, 9 April 2016 (UTC)[reply]

  •  Comment The court decision is about WMSE's use of Commons images on a website. It is unclear exactly what you are permitted to do with depictions on the Internet (if anything), and it would be a good idea to await the final court ruling. However, there is also a risk that sculptors and architects might sue individual Commons contributors. It is unclear how a court would rule in this situation, and even if the Commons contributor would win, the legal process may put a lot of stress on the contributor, so if a Commons contributor is afraid of being sued by a rights holder, then it may be better to delete the files out of courtesy. Deleted files can always be undeleted in the future, should it turn out that the files are fine. If the decision is to delete, then it would be a good idea to first check if some of the artworks are {{PD-old-70}}. --Stefan2 (talk) 19:50, 10 April 2016 (UTC)[reply]
  •  Comment The risk of being sued is very small. BUS has stated that they won't chase individual photographers sharing photos on the internet. They want money from commercial organizations. And an individual artist would first request a deletion before going to court. As stated earlier, there is no need to hurry.--Historiker (talk) 20:15, 11 April 2016 (UTC)[reply]

 Keep As I see this matter, the legal advisors of Wikimedia Foundation follow the BUS legal case against Wikimedia Sweden and will at due time form an opinion in the matter of, which will guide whether certain images should by legal considerations visavi interpretation of Swedish copyright law. So far, we just have a decision by the Supreme Court, answering questions by the lower court. There is no hurry to take actions before the lower court decision in the case later this year. Här är två experter som säger nej, man får inte sprida. När det är så kan jag ju inte rimligen få släppa bilder under en fri licens om jag inte ens själv får sprida bilderna elektroniskt. Jag förstår att det kanske är liten risk att privatpersoner råkar illa ut eller blir föremål för någon stämning men för mig räcker det med att det inte är okej för att jag ska känna att jag inte kan släppa bilderna fritt. /Hangsna (talk) 19:49, 12 April 2016 (UTC)[reply]
