They are from the Imperial Household Agency of Japan website. The website recently introduced new Terms of Use that is compatible to CC-BY-SA-4.0 ({{GJSTU2}}), but depictions of the imperial family members are exceptional and fall outside the ToU (see 2) No infringement of third party rights section of the ToU), meaning not freely licensed. Keep The Imperial Household Agency (website administrator) says "The Terms of Use are compatible with the Creative Commons Attribution License 4.0. This means that Content based on the Terms of Use may be used under the CC License in lieu of the Terms of Use". And it says "皇室の方々の著作物，ご肖像 are not licensed under the Creative Commons Attribution License 4.0." But this file is a picture of small backs of their Majesties the Emperor Akihito and Empress Michiko. This file is not a picture of ご肖像 of their Majesties the Emperor and Empress.--空駆ける天馬の閃き (talk) 04:46, 30 May 2016 (UTC)
- The ToU lists Pictures and Images of the Imperial Family as an indication of Third Party rights, implying that any kind of depictions of imperial family members is an exception of the ToU, even if their faces are not shown. The Japanese term ご肖像 can be translated as "portraits", but that does not necessarily mean faces. Yasu (talk) 16:02, 30 May 2016 (UTC)
Delete 当該画像は公開の式典において撮影された天皇皇后の写真であるため、天皇皇后の有している肖像権等に関してはあまり気にするものでもありません。しかし、宮内庁ホームページ利用規約およびその別紙によれば、「皇室の方々が写っている画像，映像等」を「別の利用ルールを適用するコンテンツ」として利用ルールから除外しています。別紙をみるに、それは第三者この場合天皇皇后が権利を有しているからというわけではなく、「ふさわしい取扱いがなされることを前提に掲載している」ためと考えられます。当該画像は宮内庁職員が撮影した職務著作であることが推定されるものの、当該利用規約が宮内庁ホームページに掲載された宮内庁職員による職務著作すべてに適用されると解すべきではなく、当該画像は別紙に該当することにより利用規約の適用から除外されているものと判断すべきであります。--Ohgi (talk) 14:48, 31 May 2016 (UTC)
Comment 宮内庁は、当該ウェブサイトのコンテンツを、クリエイティブ・コモンズ・ライセンス表示4.0国際と互換性のある政府標準利用規約（第2.0版）の下で公開しています。なお、宮内庁は、「皇室の方々の著作物，ご肖像」には政府標準利用規約（第2.0版）は適用しないと表明しています。つまり、太平洋戦争前風に言えば「御真影」には政府標準利用規約（第2.0版）が適用されません。しかし、今回のファイルは、天皇皇后両陛下の後ろ姿が遠景で小さく写りこんでいるに過ぎません。したがって、このファイルは「皇室の方々の著作物，ご肖像」には該当せず、政府標準利用規約（第2.0版）が適用されると考えるのが妥当でしょう。もちろん言論の自由がありましょう殻「遠景で小さく写りこんだ後ろ姿だって、肖像に該当する！」などと強弁することは自由です。しかし、常識的に考えて、表情が完全にわからないような遠景で小さく写りこんだ後ろ姿のことを「肖像」と日本語で称するのかは、論ずるまでもないでしょう。たとえば、このページ冒頭の天皇皇后両陛下のお写真などは、当然に御真影に該当しましょうから、政府標準利用規約（第2.0版）が適用されないことは明らかでしょうが。--空駆ける天馬の閃き (talk) 20:00, 12 June 2016 (UTC)
- Comment 「皇室の方々の著作物，ご肖像など」すなわち「ご肖像」に限定されていないので、「ご肖像」に該当するか否かを判断することに意味はありません。Ohgiは上記の通り、「ご肖像」ではなく「皇室の方々が写っている画像，映像」に該当するか否かを検討し、削除票を投じています。--Ohgi (talk) 02:38, 13 June 2016 (UTC)
