-- Explanations -- — Preceding unsigned comment added by Titrisol (talk • contribs) 16:18, 28 September 2019 (UTC) Jaime Rivadeneira was my grand father, the picture form the 1960s was taken by my father, it's a family picture which I have digitized, cropped and cleaned spots and scratches, it is not under copyright as it was not a publishable or work-for hire[reply]

Jaime Rivadeneira frente al microscopio was taken before 1935 and the photographer is uknown, the picture was in a photo album and it's about 2x2" and has no markings to identify the author. According to Ecuadorean copyright laws, it is under public domain now since it's been more than 70 yrs and the author is unknown (art 80 http://www.sice.oas.org/int_prop/nat_leg/Ecuador/L320c.asp#l1t1c1s6p2.2 states: "La obra anónima cuyo autor no se diere a conocer en el plazo de setenta años a partir de la fecha de la primera publicación pasará al dominio público. Si antes de transcurrido ese plazo se revelare el nombre del autor, se estará a lo dispuesto en el inciso primero de este artículo.")

Ecos de Guayllabamaba was the parish bulletin, purposely made to remember Jaime and to remind people that there used to be malaria in that valley; It was intended for educational purposes and I have asked the Parish office for authorization — Preceding unsigned comment added by Titrisol (talk • contribs) 16:12, 28 September 2019 (UTC)[reply]

As of 10/18/19 I have received authorization from the parish office to use the bulletin for educational purposes, I don't know where to upload that letter --Titrisol (talk) 13:36, 18 October 2019 (UTC)[reply]

Deleted: two, kept one.

  1. The parish office must send a free license using OTRS. In order for the image to be kept here, it must be clear that all of the text in the image and the photo was paid work for hire or that the creators have licensed the copyrights in writing.
  2. The image from the 1960s is certainly still under copyright. If the uploader's father, the photographer, is still living, then he must send a free license using OTRS. However, I have assumed that the father has passed on and that uploader is their father's heir, so the uploader has the right to freely license the image.
  3. The law quoted above says that for anonymous works, the copyright lasts for 70 years after first publication, not 70 years after creation. According to the description above, the first publication of the photo album image was when it was uploaded to Commons, so the copyright will expire on 1/1/2090.
