French FOP problems of PIERRE ANDRE LECLERCQ (talk · contribs)
[edit]These photos are derivative of architecture/sculpture/signage in France. They appear too modern to be {{PD-old-70}} and do not appear de minimis to me. France's freedom of panorama exemptions are insufficient for Commons. Some of these files may qualify for transfer to a local wikipedia. Note: I requested in April that this user curate his photos and made him aware of FOP rules, but he seems to have declined to address the problem. Storkk (talk) 14:42, 16 June 2016 (UTC)

- The files at COM:TOO#Architecture used here as precedents include, e.g. Commons:Deletion_requests/File:La_Defense_dsc07138.jpg and Commons:Deletion_requests/File:CSG_Ariane_4_Launch_Site.JPG, outcomes which seem somewhat strange 5 years later. It is also unfortunate that as a list of precedents, the many hundreds or thousands of "delete" closures of similar files are not mentioned at all, and some of those that were kept were not even kept for TOO reasons, but rather for (IMO spurious) DM reasons, so I would suggest not relying on those as precedents. Storkk (talk) 09:05, 1 July 2016 (UTC)
- @Storkk: As per COM:FOP#France: Buildings must have a "definite artistic character" (« un caractère artistique certain »), as opposed to the building being purely functional. As I already stated, nothing special in this photo... --P 1 9 9 ✉ 13:44, 7 July 2016 (UTC)

- If your association created the statue and holds its copyright, and if you can legally represent the association (what is your relationship with them?), then I think File:Mariage_Epona_-_Guillem_le_contrebandier_(2).jpg and File:Epona géant des Près Villeneuve d'Ascq.jpg could be OK... however, all of the others photos of this statue seem to contain other statues as well. - I was in the leadership as Secretary of the association in the association of the Local Community Residential. (L.C.R DES PRES - Villeneuve d'Ascq) during 11 years (1990 - 2011).- This is how we collectively designed and entrust the realization of this giant by a plastic, to create an animation in the neighborhood "Les PRES". Should we consider these "small giants" as well as works of art whose fame is worldwide? best regards.---Pierre André (talk) 15:23, 20 June 2016 (UTC)

- Comment English: For over twenty years the municipality of Morighem, launched this scarecrow contest (épeutnaerts in patois Picard), made by locals to attract the curious. From 1 April, the first épeutnaerts starting to get some air, until April 30, where they end up in a big fire during a garden party with a fireworks inbonus, there is no artistic copyright in such works.Best regards.
- I am unaware of any provision of French copyright law that exempts works intended to last one month before destruction from copyright. Is there such an exemption? Storkk (talk) 15:44, 20 June 2016 (UTC)
- I do not know if there is a specific law to work to last a month before the destruction of copyright. - What is your basis for asserting the building is old? The brickwork seems modern (1970s?)... I have similar issues with many of the other bold assertions of PD-old here. Storkk (talk) 08:34, 7 July 2016 (UTC)
- @Storkk: You let yourself be fooled by clean brickwork, which is no indication of the building's age. The architectural style is much more indicative. And this building is from circa 1906 (see here). This is exactly the reason why I would have preferred closing this mass nomination and have the files looked at individually. --P 1 9 9 ✉ 13:31, 7 July 2016 (UTC)
- @P199: the blog you link to would seem to support my view that the building is modern. The only old photo I found on that blog was http://3.bp.blogspot.com/-q8eV_JRAGr0/UN4CErfq8HI/AAAAAAAACFI/N16bRyC4NDQ/s1600/063-Matelot2b.jpg , which would not appear to support your assertion. As an admin, you are of course entitled to close this DR... if you do so, please re-nominate those you feel problematic. I thought this would be the the least inconvenient way of addressing this problem, and so invested some significant time in trying to make it less painful where I could, clearly you disagree. However, that there are a significant number of problematic files is, IMO uncontroversial. They should be some subset of this large list, so at least the time spent will have been worthwhile to get them all in one place. Storkk (talk) 14:09, 7 July 2016 (UTC)
- You consider 1906 to be "modern"??? No, I will not be the closing admin because I realize that some of the issues here are subjective. This way another admin can review it as well. --P 1 9 9 ✉ 14:21, 7 July 2016 (UTC)
- @P199: well, yes: an artist/architect working in 1906 would not clearly have died before 1946. But my point was more that the building with the modern brickwork does not appear to be present in that photo; it is a modern addition as that photo attests. Yes, a sculpture (which appears different) and spire are present, but the building with the "Santa Fé"-esque brickwork appears new. Storkk (talk) 14:30, 7 July 2016 (UTC)
- Keep - The architecturally interesting tower is clearly historical (the restaurant it was built for seems gone). The new shed and garden wall along the street are nondescript and way below the threshold of originality. Using differently colored and shaped bricks that someone just happened to have at hand does not establish any architectural copyright for an otherwise entirely unremarkable structure. --Latebird (talk) 13:50, 17 July 2016 (UTC)

Storkk (talk) 12:51, 16 June 2016 (UTC)
- @Havang(nl): you have asserted a number of files depict works that are PD-old, but you have not asserted a single death date or author identity. For a building erected in e.g. 1910, why do you think it is PD-old? Storkk (talk) 14:36, 16 June 2016 (UTC)
- I don't know what information User:Havang(nl) has access to, but assuming an average life time of 80 years and assuming that a building can be made at any time during the architect's lifetime, I'd expect that somewhere around half of all buildings from 1910 are PD-old-70. It may be better to nominate photos of such buildings separately so that the discussion is simplified if some architects are identified. --Stefan2 (talk) 15:18, 16 June 2016 (UTC)
- If more than a couple architects are identified, I will consider splitting the DR. If only a few architects are identified but they are post-1945 deaths, I will add the files to the appropriate Undelete in... categories manually. Storkk (talk) 15:29, 16 June 2016 (UTC)
Speedy close. There are far too many images nominated here, many of which don't need to be deleted IMO (see above, I looked at the first 30 images and already many of them I deem acceptable). These images should be nominated separately or in smaller batches. --P 1 9 9 ✉ 19:13, 30 June 2016 (UTC)
- @P199: FWIW, I strongly disagree with your "DM" arguments above... the photographs are clearly of the architecture, meaning they cannot be COM:DM (see criteria 6/7). Storkk (talk) 08:32, 1 July 2016 (UTC)
- Sure, some may be borderline like File:Hautes-Pyrénées, La Mongie.jpg, but others are clearly not (like File:La Mongie.- La Chapelle Notre-Dame de La Mongie.jpg). --P 1 9 9 ✉ 19:26, 4 July 2016 (UTC)
- I have no idea how to analyse this. I picked Latvia as I know this countries well enough and I found too many erors. For instance, File:Daugava river..JPG is a photo of Daugava River, surely it has something copyrightable in the background, but the focus is clearly on the river. File:Riharda Vāgnera iela 5, Rīga, LV-1.jpg is a coat of arms on an old municipal building, I fail to see what is copyrighted there. File:Le Pont de chemin de fer sur la Daugava.JPG depicts a bridge built back in 1914 (see the 1914 postcard, File:Рижские железнодор мосты через Двину открытка.jpg), thus {{PD-RusEmpire}}. I don't know if criteria were the same for other countries but this seems like too much for me — NickK (talk) 01:07, 6 August 2016 (UTC)

- I do not dispute that the building itself is old. What appears very modern is the painting, both in the background of the statuette, and also the ornamental patterns elsewhere. Storkk (talk) 07:41, 20 June 2016 (UTC)
- Yet I am in good times having seen that file . Best regards.--Pierre André (talk) 15:53, 20 June 2016 (UTC)
- That appears to illustrate my point. They appear to be in the middle of painting decorations in the photo you just provided. The top half of that building is probably OK copyright-wise; the bottom half might be de minimis (or not), but seems to illustrate my point that the paintwork is modern and likely copyrighted. I do not believe that the paintwork in your photos is de minimis. Storkk (talk) 16:05, 20 June 2016 (UTC)

- Storkk, did you see Special:Diff/199179948? Based on that edit, it sounds as if Belgium is going to get FOP soon. --Stefan2 (talk) 16:06, 17 June 2016 (UTC)
- @Stefan2: I did not see that. That would be excellent news if it happens/happened. I'm not sure exactly what "plastic, graphic or architectural" artworks are, but it seems likely buildings would count... less certain about things like statues/monuments made out of materials other than plastic or things like Commons:Deletion_requests/File:Mont-St-Aubert_La_maison_des_poètes.JPG. Storkk (talk) 17:25, 17 June 2016 (UTC)
- It appears that during this DR Belgium has enacted robust FOP laws, so I am withdrawing all of the Belgian files. Storkk (talk) 15:36, 7 July 2016 (UTC)

Speedy close. There are far too many images nominated here, that can't be reviewed properly against the various criteria. These images should be nominated separately or in smaller batches. --P 1 9 9 ✉ 19:22, 30 June 2016 (UTC)
- @P199: I find it hard to believe you are seriously suggesting ~400 separate nominations, especially considering that would likely break the uploader's talk page. Secondly, this is obviously not a "speedy" close candidate. Storkk (talk) 08:29, 1 July 2016 (UTC)
- Granted, ~400 separate nominations are also overwhelming, but looking at the various comments already posted above, there are numerous files that should not be deleted but now risk being deleted as a part of this mass nomination. OK, I will try to review the list above over the next few days. --P 1 9 9 ✉ 19:26, 4 July 2016 (UTC)
Deleted: files with obvious FoP issues, kept about 125 files. If you feel some of them still should be deleted, please create separate DRs. Next time please don't create an unmanagable DR like this. --Jcb (talk) 16:52, 13 August 2016 (UTC)
