According to Real Decreto Legislativo 1/1996, de 12 de abril, por el que se aprueba el texto refundido de la Ley de Propiedad Intelectual, regularizando, aclarando y armonizando las disposiciones legales vigentes sobre la materia.[1]:

Artículo 13. Exclusiones.

No son objeto de propiedad intelectual las disposiciones legales o reglamentarias y sus correspondientes proyectos, las resoluciones de los órganos jurisdiccionales y los actos, acuerdos, deliberaciones y dictámenes de los organismos públicos, así como las traducciones oficiales de todos los textos anteriores.

There is no restriction to photographs, graphics, ... If photographs, graphics,... are part of legal or ruling dispositions and their correspondent projects, resolutions of jurisdictional organs and acts, agreements, deliberations and reports of public organizations are not subjected to "intellectual property".

Saludos LMLM, creo que tienes toda la razón del mundo. Además en tu caso basta pinchar la fuente para darse cuenta que esa foto esta ahí, en una ficha de un archivo patrimonial de la comunidad, precisamente para estar en dominio público. Te invito a visitar la página
