These images show paintings of Earl M. Pilgrim (1923-1976), an American artist. They may or may not have copyrights. They do not appear to have notice, which would have been required if published before his death, so they may be PD, but if unpublished until after 1989, they may still be under copyright. Pilgrim may or may not be notable. The WP:EN article is new today and contains only two images and no text. There is also a draft article awaiting review. A Google search brings up very limited relevant hits, suggesting a lack of notability.

Therefore we need two things to keep these images on Commons.

  • First, a license from Pilgrim's heirs using the procedure at OTRS.
  • Second, some evidence of notability.

The uploader's account was opened last month on WP:EN and yesterday on Commons and has been used for nothing but this subject. I also note that all of these images are incorrectly licensed -- the uploader is claiming CC-BY-SA GFDL, but since they are all images of paintings, the photographs have no copyright.

Hi all, I work for the Estate of Earle Pilgrim. The artist in question is a notable artist who worked with various High Modernist figures such as Alan Kaprow and Lester Johnson and has recently had an exhibition of his work at the Provincetown Art Association and Museum. There has been very little scholarship on the artist as his works have been stored away by the artist's widow since his death in the 70s. What we are trying to do at the Estate is to generate scholarship, which has been initiated by a student working on his thesis at a university in Washington DC, and accessibility which brought us to Wiki. As I noted above, there are three issues here, none of which you have addressed.
Merely claiming notability does not prove it. Generally Commons will accept a WP article as good evidence. An artist whose work has been stored for forty years does not strike me as notable, but others may disagree with me.
The executor or other authorized representative of the heirs to Pilgrim's copyrights will have to provide a free license to all of the paintings shown in the images listed above -- see OTRS for forms and addresses.
Some of the images show a CC license. Since the images are mere copies, they have no copyright and therefore cannot be licensed. When and if we receive a license from the estate, then the descriptions must show that license for the paintings, but none for the images.
Finally, you should note that both Commons and WP:EN have rules about editors who have conflicts of interest. Since you work for the estate, that applies to you. I suggest you read and obey WP:Conflict of interest and, at a minimum, put a notice of your connection with Pilgrim's estate on your user page both here and there. .     Jim . . . . As of now, there is no recent OTRS request containing either "Earle" or "Pilgrim". I see that you have not complied with my final point above.
