[edit]

These are Flickr Public Domain Mark 1.0 images, which is not accepted on commons. The images were tagged as having no license. The uploader changed it to {{Cc-by-sa}}.

Keep — I really don't see JuTa (talk · contribs)'s problem. The author of the photographs on Flickr has waived the rights: anybody can use them freely. The objects in the photos are many centuries old and are already shown in a lot of Commons files in the categories Cannons in the Haut-Koenigsbourg castle and Salle d'armes, Château du Haut-Kœnigsbourg. There is no copyright issue whatsoever. --Edelseider (talk) 20:39, 20 August 2017 (UTC)[reply]
  •  Delete: A Public Domain Mark (PDM) tag here on the flickr source is incompatible with Common's licensing policies. The copyright owner retains full control over this image and does not give away any rights. Commons can be sued by the copyright owner. PDM is not really a license and therefore is not permitted on Commons except where it can be shown that the image is PD for known reasons such as a US Government image. See this flickr license table, where Commons can generally only take flickr images with Attribution, Attribution-ShareAlike or public domain dedication (CC0) licenses. PDM is revocable by the copyright owner at any time....and that is why Commons does not take this license from a private individual unless the work depicted is by an artist who has been dead for 70 years. A license change to one of the three licenses mentioned is needed here. --Leoboudv (talk) 05:04, 23 August 2017 (UTC)[reply]
More accurately, PDM is a statement that the uploader thinks the image is in public domain, but the reason of the uploader thinking so is not stated. It does not imply that the uploader is the copyright holder and/or is able to release the image into public domain. --Zhuyifei1999 (talk) 11:31, 23 August 2017 (UTC)[reply]
Comment Then how come the Flickr2Commons tool allowed that I upload these images? --Edelseider (talk) 06:34, 23 August 2017 (UTC)[reply]
  •  Comment: Because someone forgot to close that loophole at Flickr2Commons . But if the copyright owner notices his/her images being used, he/she has a legal basis to sue Wikicommons unfortunately. The people at flickr created this problem and many users think that PDM is equivalent to CC0 but they're totally different and PDM is unenforceable. --Leoboudv (talk) 07:13, 23 August 2017 (UTC)[reply]
Comment Very well. I have no reason to doubt your comments. Go ahead with deleting the files, then (or ask the Flickr guy to change their licence, which would be much nicer). Cheers, --Edelseider (talk) 07:27, 23 August 2017 (UTC)[reply]
No, PDM images may actually be accepted here if there is a valid proof that they are public domain. See {{Remove this line and insert a public domain copyright tag instead}} --Zhuyifei1999 (talk) 11:31, 23 August 2017 (UTC)[reply]

Deleted: per nomination: these are nor PD-old, nor (explicit) PD-user. Ruthven (msg) 22:43, 3 October 2017 (UTC)[reply]
