@Nesnad: Rob DiCaterino (the stated author) released the photo with a Creative Commons license on Flickr. Rob DiCaterino however, is seen on the right in this photo. So he's not behind the camera. The photo was most likely taken by a bystander (or Lanza, someone else who was with them) and the copyright is with the photographer, whoever that was. Do you have evidence that the uploader is really in the photograph and not just claimed or that the license wasn't given to the Flickr user? Further, it could be a tripod for all we know. It seems like you are making a lot of assumptions. However, clearly even if a bystander took the photo no reasonable person would expect them to suddenly claim copyright on it. @Nesnad: I doubt they would carry a tripod around when going to an event. Also, the angle changes between File:Chiller Theatre Expo, Parsippany, NJ, 27 April 2013.jpg and File:Chiller Theatre Expo, Parsippany, NJ, April 27, 2013.jpg. That would mean they adjusted the imaginary tripod. The description says "pictured (left to right): Greg, William Zabka, and Rob (me)", should we doubt this? I agree the bystander (or Lanza) is unlikely to claim copyright, but bystander selfies have been discussed before. We don't know if they had a tripod and moved it. I have a tripod. It could be a drone. It could be many things. I just think it's weird to be all fastidious about this upload. Further, from your own link it's clear there is no consensus on deleting bystander photos, so you are going out on your own trying to delete these. Nesnad (talk) 04:02, 29 June 2019 (UTC)[reply]
@Nesnad: I am not on my own, this is the current practice. If we have significant doubts about copyright ownership (and Commons:Own work/Bystander selfie is no policy yet), COM:PRP suggests deletion. The scenario where this photo was taken with a tripod is just really not that likely. While not impossible, it's not likely. As I was searching around, I found more information and the current practice could change in the not-too-distant future as a result. Probably not before this DR is closed, although, the backlog is pretty huge so who knows. - Alexis Jazz ping plz 04:20, 29 June 2019 (UTC)[reply]
But if you do not if it was a tripod or a drone or if the bystander signed over rights to uploader, how can you nominate for deletion just on your own "feeling" that it is a bystander photo? Just seems like taking the letter of the law and over applying it to feel good about stomping on things. We should be here making things not finding weird conditions to stomp on things. @Nesnad: You don't know me at all, do you? If anything, I would probably be considered an inclusionist. I only came across this image because someone else nominated it first for another reason. And as I said, current practice will possibly change in the not-too-distant future now as Commons:Own work/Bystander selfie will probably be proposed again with better arguments.
