Tattoos are classed as art, and as such, the underlying designs on the tattoo AND the tattoo itself, need to be either released into the public domain and/or made available under a free licence. The release needs to come from the designer of the underlying elements of the tattoo, and from the tattoo artist who did the tattoo -- I would not suggest a CC licence, due to the attribution requirements of that licence, and would definitely not suggest GFDL as this may require the licence to also be tattooed somewhere (the back or chest is probably the only option there), so a public domain release from both the designer of the artwork, and the tattoo artist would probably be best here.

  • Comment In my opinion we only need to license the photo, not the design. (Though of course my opinion does not equal in-depth understanding of copyright red tape.) Does photographing a room require licensing everything in it? Regardless I'm happy to release the design at whatever level is required. Heather, one can look at say en:Ed Hardy, to understand that tattoos are copyrightable, and one can then look at en:Christian Audigier to see that licences have to be given for those copyrightable artworks. The question is are these designs simple enough not to attract copyright; the answer to that would be they clear the threshold of originality, and hence to be eligible for hosting here on Commons the design needs to be made available a free licence, and all derivative works of that design also need to be made available under free licence -- the photos are simply the third link in this chain. russavia (talk) 00:13, 10 September 2012 (UTC)[reply]
