Superman statue in Metropolis, Illinois
[edit]Setting aside any potential issues of character copyright, the current Superman statue in Metropolis, Illinois, was created in 1993 (source), and is therefore automatically copyrighted without any requirement for notice or registration. Therefore photographs of it are unauthorized derivatives of a copyrighted work, and must be deleted.

- (ec) Not so. "Public domain" is not a positive claim, it's a negative claim (the absence of copyright). More specifically, the relevant law (17 USC § 105) says "Copyright protection...is not available for any work of the United States Government..." So, assuming it's actually a work of the US government (source is now a dead link), the photo can not attract any additional copyright protection, but that doesn't cancel out copyright claims due to the depiction of non-government copyrighted works, such as this.
- Further, I see no actual evidence of it as a US government work. The source is now a dead link, but checking through the Internet Archive's Wayback Machine, the caption gives no information about the photographer. I don't know that we can assume that, just because it's hosted on a US government site, it is necessarily a US government work in the copyright law sense. cmadler (talk) 19:48, 24 December 2012 (UTC)
- Delete all. File:Barack Obama with Superman cropped.jpg has an odd licence: {{self|PD-USGov}}. Is the uploader the US government? {{PD-USGov}} doesn't help for any image since the statue isn't a work by the US government. The US government can only put the photographic copyright in the public domain whereas the statue copyright remains with the sculptor (or DC Comics or whoever the copyright holder is). --Stefan4 (talk) 19:37, 24 December 2012 (UTC)

How does this issue become resolved? There is no precedence to claim copyright on this image. Unless someone whom believes themselves to be the owner of this image comes forth there is nothing to talk about. I hope this issue becomes resolved today.
