Files not PD in US

Kept: There has been no discussion about these images, therefore I do not see sufficient arguments for deleting it. The Wikimedia Foundation – through the statement of the Legal department - does not see a reason to delete content simply because of general concern about the URAA. The document on Commons at COM:URAA states “A mere allegation that the URAA applies to a file cannot be the sole reason for deletion. If the end result of copyright evaluation is that there is significant doubt about the freedom of a file under U.S. or local law, the file must be deleted in line with the precautionary principle.” Nobody took the effort to participate in this discussion, therefore I decided to keep the images, because they are having a correct licence for the country where they originated. In addition, the file pages are showing a warning sign that a licence tag is missing which will show the image is possibly not in public domain in the USA which will prevent re-users from USA to use it freely without additional research. If you do not agree with this decision, you are kindly requested to nominate the image again for deletion in order to have a broader discussion about it. --Ellywa (talk) 20:19, 8 October 2022 (UTC)[reply]

Literally the first sentence of Commons:Copyright rules says files must be free both in the US and the country of origin. I don’t know how this is controversial.

@Dronebogus The statement by WMF Legal says (among other things):
  • There are other factors that must be considered (including, but not limited to, the reason that the work entered PD in the US prior to the restoration date).
  • The {{Not-PD-US-URAA}} tag may be incorrect, and cannot be relied on as an argument for deletion.
Unfortunately, this information is not clear from other statements about the URAA.
In any case, it was wrong to tag these files {{Not-PD-US-URAA}} because they were uploaded after 1 March 2012. Brianjd (talk) 10:49, 21 December 2022 (UTC)[reply]
