Derivative work of Matt Furie's character Pepe the Frog

For File:Gate of The Young's Hainan Chicken.jpg, I would argue De minimis applies. Pepe the Frog is identifiable and an unavoidable part of the image subject, but is not essential to the subject (Gate of The Young's Hainan Chicken). Onthewings (talk) 13:44, 25 December 2023 (UTC)[reply]

Graffiti is not public-domain, and if it contains non-trivial protected content is often deleted. We know Furie actively protects Pepe, so we should default to delete here as all of these are DW unless one can make a specific DM case. I think the Gate is not DM but is instead an overt DW that appears to use Pepe as part of the logo of the business, and that blotting it out (leaving a mostly blank gate) substantively changes the character of the image. Per Commons:Toys

 Keep COM:TOYS is not a policy that 'any pictures of toys must be deleted'. Instead it's a recognition that toys, like most things, may incorporate a creative input that is protectable by copyright. However it isn't a given that there will be any creative input in the design of the toy that is thus protectable.
In this case, the toys are Pepes. The original creativity still resides with the cartoon, not the toy. I see no new creative effort beyond that. So we're back to a situation closer to COM:COSPLAY. Andy Dingley (talk) 17:03, 22 April 2024 (UTC)[reply]
