  •  Oppose Fair use, I would say. An article about the OV-Chipcard should be able to have pictures of the OV-Chipcard. I do not think TLS can prevent us from having these. PPP (talk) 09:26, 18 July 2014 (UTC)[reply]

        • That is an odd thing to say, but this being the internet I have to at least consider the possibility that you are serious. No, if everything is a derivative work you are saying people cannot create original works, making copyright in itself redundant. Besides, even derivative works can be uploaded if the copyright term has expired, if the owner has provided permission, or if a legal restriction permits it.           • (this was my answer to your question if I know anything about copyright laws before you edited it away) Apparently not enough to know the difference between a picture of an OV-Chipcard and that of any other card (bank card, credit card, Oyster card, etc.), or even a vending machine bearing some logo or text, a train carrying the transit company's logo, a street view with logos of shops in that street, a table designed by somebody else who might still be alive etc. etc. etc. So please, enlighten me, what's the difference exactly?             • The question first of all seems to have nothing to do with your initial statement on fair use. Second, I cannot answer your question in concreto, because I do not know what the pictures you are talking about might look like. There may be a restriction that applies, such as freedom of panorama, or the fact that it is a government work. It may be the copyright has expired, or the owner has given consent to the use under a free license. The train cards and OV-chipkaarten in this RfD are probably all protected under copyright, so unless you can show that a restriction applies or the owner has given consent, pictures of these objects cannot be distributed under a free license. There is massive confusion and irrelevant debate about these pictures. First: TLS issues these cards but is not responsible for its use are what printed on them. These cards are issued and printed by the public transport companies involved: NS, Arrival, GVB, etc. TLS only delivers blanco cards.

These files should be treated as public transport tickets and checked individualy for logos and other protected works. It is the same as if bankcards containing the same electronic chip are collectively deleted. As the original files are not accessible I cannot make judgement as to the copyrigth status. The discussion should be restarted with the correct arguments. Smiley.toerist (tildes are posible on mobile phone)
