- Keep. Aside from annoying m:copyright paranoia mentality shown here, this nom bundles images that may fall under Commons:Freedom of panorama, Commons:Fan art, Commons:De minimis (File:Balloons 2.jpg), COM:GRAFFITI, and others. Please relist as individual noms, and we will discuss it there. --Piotr Konieczny aka Prokonsul Piotrus Talk 08:49, 17 March 2014 (UTC)

In the case of File:Muyayo001.jpg, though tattoos may come with an implied license that allows public display, it is not clear that photographic reproductions are permitted.

- It's a little unfortunate that you didn't seem to look at Commons:Image_casebook#Costumes_and_cosplay. That would seem to save File:Darth Vader wearing traditional ukrainian clothes.jpg at least... AnonMoos (talk) 09:59, 10 March 2015 (UTC)
- No, I looked at it. I understand your comment, but the point here is that, although the overall "costume" in the Ukrainian case can be regarded as a "modified or original representation of a character" the issue here is in the Darth Vader mask. It's copyrighted, it's covered by COM:TOYS and cannot be regarded as a de minimis element within the picture. On the contrary. The picture is of course a modified representation, but keeps unmodified prominent elements of the original copyrighted element. I do acknowledge it's a border case, but not unfounded at all. --Discasto talk | contr. | es.wiki analysis 16:24, 12 March 2015 (UTC)
- If it's being actively worn by a person in a manner like an article of clothing, then: 1) It's a little dubious whether it can be called a "toy" in the most useful meaning of the word. 2) Its "utilitarian" function is specifically not copyrightable under United States law. The image may end up needing to be deleted in the end, but I wish you would stop throwing the word "toy" around, because I don't think that it clarifies any issues in this case. AnonMoos (talk) 00:53, 13 March 2015 (UTC)
- Good point, but don't blame on me but on COM:TOYS. It explicitly mentions the Darth Vader example. If the Darth Vader mask is a "utilitarian" object, then it should be discussed there and not here, I guess. --Discasto talk | contr. | es.wiki analysis 08:44, 13 March 2015 (UTC)
- Delete all. According to [1], Stormtrooper helmets are copyrighted artworks in the United States (but ineligible for copyright as utilitarian objects in the United Kingdom). As the helmets are unfree in the United States, we can't host any pictures of them. --Stefan4 (talk) 11:55, 13 March 2015 (UTC)

- Delete per nom. Also, I think it's time that the category be salted, and that we develop a means of preventing uploads of well-known copyrighted characters/works. –LaundryPizza03 (dc̄) 06:33, 15 September 2019 (UTC)
- The diagram on Derivative works explains that a picture taken in country where the freedom of panaorama is allowed can be uploaded under a free licence. Yuraily Lic should check each picture before proposing a whole category to the deletion. --Cody escadron delta (d) 13:24, 15 September 2019 (UTC)
- Cody escadron delta, the creators of the characters have copyrights. It doesn't matter where photos were taken. --Yuraily Lic (talk) 15:05, 15 September 2019 (UTC)

- According to Christian Ferrer (an administrator), "FoP could apply if it was the first publication/creation, however the person who made the graffiti made a DW of a copyrighted character, the owner of the former character still have rights on it" from Com:Deletion_requests/File:Mazinger_Z_Sabadell.jpg. Therefore, these are files to deletion as COM:DW of copyrighted characters. --Yuraily Lic (talk) 03:08, 16 September 2019 (UTC)
- Yes because the graffiti is a DW, but for example, the picture File:Gateway to space 2016, Budapest, Darth Vader.jpg was taken during a Star Wars exhibition. So the Darth Vader costume here is not a DW, it is an original copyrighted costume and mask, so it is a 3D artwork, like a statue. So the FoP must be applied here. --Cody escadron delta (d) 12:35, 16 September 2019 (UTC)

- Thanks for the copy/paste answer, it's always a pleasure to speak with a robot! Anyway "mass deletion request" are meaningless, most of these pictures, 24 exactly are in the same case than the spiderman costume : Commons:Deletion requests/Images of costumes tagged as copyvios by AnimeFan/Mike Godwin mail. The answer of the lawyer Mike Godwin is clear : "Suppose someone dresses up as, say, Spider-Man, and has a photo taken. The photo is neither a copyright violation nor a trademark violation.", if we change spider-man by darth vader, we got the same case. Please make individual request and be sure you are not in a FoP or Spider-man case.
- According to [2], Ellin Beltz (an administrator) concluded "Darth Vader masks are copyright". --Yuraily Lic (talk) 12:54, 22 September 2019 (UTC)
- Spider-man mask is copyrighted too and according to the wikimedia fondation's lawyer "the photo is neither a copyright violation nor a trademark violation". It seems the pictures deleted by Ellin Beltz showed toys and not a person "dresses up as" Darth Vader. Do not forget that an administrator can be wrong, they are not all-knowing. --Cody escadron delta (d) 05:47, 24 September 2019 (UTC)

- Here another mail by Mike Godwin about costume :
- “I do not see a legal justification for removing the images we are discussing here. It is common for photographers to take pictures of people in costumes of copyrighted and/or trademarked characters. In general, such photographs are understood as lawful.
- I believe the deletion of the photographs you were talking about was unnecessary, and that this represents a too-conservative worldview with regard to the applicability of copyright and other intellectual property theory.
- Feel free to reproduce this e-mail on-wiki.”
- The mail can be found here : Commons:Deletion requests/Images of costumes tagged as copyvios by AnimeFan#Comment by Mike Godwin.
- So every pictures that are showing a costume, or somebody wearing a costume, should not be deleted because it is not a copyright violation. It is a different case for pictures that are showing statues or toys.
