I can't see that these images are CC-licenced at the source they've been taken from. http://www.southlakes-uk.co.uk/aup.html says "All photos are available for you to download and use for your own personal use. Any other use that is not personal is not permitted without permission from me. Photos donated to the web site are copyright to various people and we have gained permission where possible to use those photos. Please don't abuse other peoples copyright. If you see a photo that you want to use and note that it is copyrighted then you must do everything you can to contact the copyright holder."

The front page of the site does have a disheartened announcement that the site will no longer be maintained with a line that says "Feel free to look at the photos and use whatever you like as one day this site will be gone forever.", but I'm not sure that can be regarded as an explicit release of all photos (including what may be 1940s newspaper clippings) as CC or public domain.

I've contacted the Webmaster at the site to ascertain his position on the matter. Could you hold off deletion until (if) I get a response. If I don't get a response within a week I'll let you know. The site hasnt been updated for a long time. I have no issue anyone using any photo from the site but anything marked with a copyright is best trying to contact the copyright holder or at least acknowleding them. Any other photo is fine

Commons requires that photos be explicitly released under a public domain or creative commons licence, so that everyone's on the same page: see Commons:Licensing. "I have no issue anyone using any photo from the site" is great to hear, but we need to be clear that the site owner understands what Commons "using" these photos means, and is happy with that - it means the images can be reused without payment by anyone, for any purpose (even a commercial venture like a book or newspaper article).
Checking the sources, the majority of these photos are taken from the http://www.southlakes-uk.co.uk/walney.html, http://www.southlakes-uk.co.uk/bw.html, http://www.southlakes-uk.co.uk/hawcoat.html and http://www.southlakes-uk.co.uk/church.html pages of the site, none of which specify the photographer or copyright status. Does this mean all photos on these pages were taken by the site's maintainer?
Possible problem images are File:Roxy, Barrow-in-Furness.jpg and File:Ritz Barrow-in-Furness.jpg, which are taken from http://www.southlakes-uk.co.uk/cinemas.html and labelled there as "either been taken by myself or have been donated to the web site". If they were donations and/or newspaper clippings, the site owner can't grant Commons the copyright.
File:St george square, barrow.jpg is also described as "All credits and/or copyright remain with Jack Edmonson" on http://www.southlakes-uk.co.uk/old.html, so we'd need confirmation that Mr Edmonson was willing to release the image as CC-attribution.
The best and easiest outcome here might be for the site owner to add an explicit "All photos linked from this page are by [name] and are licensed under a Creative Commons Attribution 4.0 International license." line to the bottom of any page where they can confirm that all the photos are their own work (or even making a separate page on their site that links to all such photos), if they're okay with releasing the photos under a CC licence. Wikimedia Commons would then be extremely happy to take copies of those photos under that licence, and make sure that they live on here even after the Southlakes site closes. --Lord Belbury (talk) 15:15, 24 January 2021 (UTC)[reply]

That's great to hear, many thanks. Given the phrasing I think we'd have to play it safe and delete the File:Roxy, Barrow-in-Furness.jpg and File:Ritz Barrow-in-Furness.jpg photos as the page they're on says that they may have been donated, and File:St george square, barrow.jpg remains credited and copyrighted to Jack Edmonson, but the rest can stay, and other Commons/Wikipedia editors will be able to take additional images from the site as needed. (I'll see if there's anywhere I can raise it on here as a photos source that's worth taking the time to archive.)
