That was when I first started Uploading. The original negatives were donated to the Sister's of St. Joseph Archives. Do I have to get permission from them? They are historically important to them and London history so how does one upload such photos after the photographer has passed? At the time of upload I owned the negatives but with instruction and clarification from someone who was assisting me at the beginning I now know the difference between the copyright owner and the negative owner buthow can historical images get on her under this situation??? ̴̴ Photo Archives (talk) 17:02, 1 November 2023 (UTC)[reply]
@Photo Archives: who, exactly, issued the CC license that you stated when uploading these photos?
We don't post copyright violations just because they are historically important. Someone is the heir to the intellectual property rights, and that is the only person who can offer a license. Otherwise, we have to delete them and then undelete when they enter the public domain, presumably 70 years after the photographer's death (and long after my own). - Jmabel ! talk 18:28, 1 November 2023 (UTC)[reply]
Thanks for the reply. I put the most recent CC the 4.0 one. What should I have put on the collection? I stated that the photographer was deceased, I stated his name and the provenance so I see your point about the 75 years but it was an estate sale and Attic books in London had no record of the owner other than his name? I tried to find more info on Spirrizzi but found none. What do I do if this comes up again? @Photo Archives: Unfortunately, these are orphan works. As Jmabel said, the copyright on these would be C. Spizzirri's heirs, if any. And if there aren't any, then you're pretty much out of luck. However, according to the Wikipedia article I linked to, because you're in Canada, you still might be able to legally use these photos, but that still wouldn't give you the right to set the licensing terms. holly {chat} 19:46, 22 January 2024 (UTC)[reply]
