The graffiti seems original enough to be copyrightable as it's in the United States. See COM:GRAFFITI and Commons:Freedom_of_panorama#United_States for clarification. Flickr license is for photograph, not graffiti. The Haz talk 10:03, 31 January 2015 (UTC)[reply]

  •  Keep Reading through the linked cases under GRAFFITI shows that the key criteria is whether the work is a legal commission or an unlawful work. It is unclear why the guidance mentions FoP as this actually seems irrelevant to the case studies. If the work is unlawful, then in the US there is no claim of IP by the creator. In comparison with Europe, there is less protection for the artist. This work is a Banksy and based on the Mayor of New York's public comments the work is considered by the state to be vandalism.[1] -- (talk) 13:54, 31 January 2015 (UTC)[reply]
