I own this image and it was posted here without my permission. Please look carefully at the left arm of President Numairi and you will see my watermark on this image (© Yass). 2A01:4B00:800D:7000:E046:602F:89B6:8DFA 10:12, 10 July 2023 (UTC)[reply]

This image is in the public domain because the copyright of this photograph, registered in Sudan, has expired according to Sudanese law. (At least 25 years have passed after the photograph was created.) Munfarid1 (talk) 10:35, 10 July 2023 (UTC)[reply]

Incorrect. This image is protected by copyright in the US and the UK and it doesn't exist in the public domain. My watermark is on this image and the photographer was my father. Furthermore, you copied this image from my post on Facebook group a day after I posted it and failed to give appropriate attribution and you also failed to obtain permission before posting the image here!!!!

Furthermore, the source of the image you quoted is a magazine in the collection of someone named Ismail Abdallah Mohammed Yousif and also protected by copyright in Sudan under © 2022, Sudan Memory as can be seen on the bottom of the page : https://www.sudanmemory.org/image/ISM-0000068/1/LOG_0000/ 2A01:4B00:800D:7000:E046:602F:89B6:8DFA 11:14, 10 July 2023 (UTC)[reply]
It is actually under copyright both in the UK and the US.
UK: Republished by AuthorHouse ISBN: 978-1-4520-2861-3 (SC) ©2011 Dr. Khogaly
USA: published by Sterling Publishing CO INC under ISBN: 0-8069-1198-0, OAK Tree: 7061-2176-7 as well as the library of the congress under catalog card no: 76-1188 2A01:4B00:800D:7000:E046:602F:89B6:8DFA 11:42, 10 July 2023 (UTC)[reply]
First, UK copyright status is irrelevant to us. Our policy requires that images published here must be free in the country of origin (Sudan in this case, unless a publication elsewhere before 28 December 1971 is provided; no such evidence in your request) and in the United States, where Wikimedia Foundation is based.
Second, the photo published in the Sudanese magazine, and the photo published in Facebook are in my opinion the same work from copyright point of view, regardless of the watermark or any © declaration.
Third, per Sudanese copyright law the photo is definitely PD; it most likely enteres PD there on 1.1.1996. The © 2022 declaration applies in my opinion to the web service and is irrelevant for copyright status of the photo.
Fourth, as the US had no copytight relations with Sudan before 2000, the photo was PD there unless its copyright was registered in US Copyright Office (no evidence for this). Urugway Round Agreement Act (URAA) established copyright protection in US for works initially published in Sudan before 2000 if they were copyrighted in Sudan on 28 December 2000. This one was not.
Fifth, republishing any photo that copyright has already expired does not restore the expired copyright. So any © after 2000 are either informative only or void.
Summarizing: I see no evidence for Sudanese or US protection, I see no evidence that the country of initial publication is not Sudan and UK copyright investigation is out of our scope for this photo (you may need to choose the legal path if you wish to exploit it - and if it still exist - what is unclear as the photographer name/death date is not provided).
Keep per above. Ankry (talk) 17:54, 10 July 2023 (UTC)[reply]
That is incorrect. The magazine acquired permission from my father to use this work. The work was then published in 1976 in the USA under copyright with Sterling Publishing CO INC under ISBN: 0-8069-1198-0, OAK Tree: 7061-2176-7 as well as the library of the congress under catalog card no: 76-1188.
It was then republished in the UK in 2011 by AuthorHouse ISBN: 978-1-4520-2861-3 (SC).
Finally, the above image contains my watermark and it is clearly the image I posted and not from any public domain. 2A01:4B00:800D:7000:8509:560:79AE:B5DA 10:04, 11 July 2023 (UTC)[reply]
