Delete. As per (https://www.seruminstitute.com/copyright.php). It is clearly mentioned under 'Copyright & Intellectual Property' section The trademarks, logos, and service marks displayed on the Site are registered and unregistered trademarks of Serum Institute of India Pvt. Ltd. and others.. @Mdaniels5757 and Jeromi Mikhael: How do you conclude its a {{PD-textlogo}}? Its a clear copyright violation. ~ Amkgp 💬 18:14, 19 August 2020 (UTC)

- The issue at hand is mainly whether the bit at the left falls below COM:TOO. I'm no expert in Indian copyright law, but as far as the US is concerned, it's...probably borderline at best. It's hard to argue that that bit consists merely of simple shapes. GMGtalk 19:21, 19 August 2020 (UTC)

Comment · Threshold of originality in India is not clear but according to Robin Singh's essay, "skill and judgement is required by the author." I don't see any significant skill and judgement exercised here: just 2 lines of colourful simple text and that mother holding baby symbol which is widely used in medical institution logos in India. -- CptViraj (talk) 06:45, 20 August 2020 (UTC)
- It might also be helpful to research how old this institute and, especially, this logo is; as per Commons:Threshold_of_originality#India older works might have to be judged by TOO criteria similar to TOO for the U.K. --Túrelio (talk) 10:55, 20 August 2020 (UTC)

- @CptViraj, Túrelio, GreenMeansGo, and Sreejithk2000: . The company was founded on 1966.(https://www.seruminstitute.com/about_us.php). As per {{PD-India}} it states As of 2020, works published prior to 1 January 1960 are considered public domain as per The Indian Copyright Act, 1957 (Chapter V Section 25). Thus, this is a copyright violation. Regarding, COM:TOO India I am also unsure. For your information the logo is much younger than the company because previously it had a bit different logo w:File:Serum Institute of India logo.svg (deleted now as per w:WP:F5). ~ Amkgp 💬 14:29, 20 August 2020 (UTC)
- @Amkgp: While there are differences between collective and individual works, the operative measure is normally not the founding of the company, but the creation or publication date of the work, or the death date of the author. GMGtalk 14:33, 20 August 2020 (UTC)
- @GreenMeansGo: You are right but its also rare to digest that the logo was created earlier 1960 for a company founded in 1966 and started operation in 1967. If we take the date of creation as uploaded date (10 August 2020) then I feel it certainly fails {{PD-India}} ~ Amkgp 💬 14:46, 20 August 2020 (UTC)
- While members of the community are often graciously willing to help out, at some level, the onus is ultimately on the uploader to justify why the content is appropriately licensed. While I don't question their good faith, it's not clear that the rationale for concerting this to a DR is ultimately sound. Similarly, the onus is ultimately on them to justify why the media is appropriate, while the onus on others is merely to demonstrate that there is significant doubt about the freedom of a particular file.
