There's no freedom of panorama for 3D works of art installed in the US after January 1, 1978, per COM:FOP US. Since en:Peurto Rico is a commonwealth of the US, it is almost certainly covered under US copyright law, which means this photo needs to be treated as a COM:DW. The uploader/photographer can release their photo under a free license if they want, but the copyright status of the memorial itself also needs to be considered. Unless the memorial can be shown to be ineligible for copyright protection (i.e. COM:PD) for some reason, or the COM:CONSENT of whomever created the memorial can be verified, I don't Commons can keep this photo per COM:PCP. -- Marchjuly (talk) 04:40, 14 June 2023 (UTC)[reply]
