The source indicates that the image is still under copyright, stating: "Images in the photo collection are intended for personal use only. Any reproduction, redistribution, publication, or other use, by any means, without prior written permission is prohibited." The photograph was taken in 1903 but that does not necessarily mean it is out of copyright since US copyright is based on publication date, which is unclear. Buidhe (talk) 03:56, 16 July 2021 (UTC)
- @Buidhe: As this was a photo of a speech by a U.S. president, I would guess it was published sometime shortly after it was taken, which would place it in the public domain. I'll be mostly offline this weekend, but I'll look into it further and see what I can find. {{u|Sdkb}} talk 07:02, 16 July 2021 (UTC)
- Comment Website notices of restrictions are irrelevant if the photo is actually PD. If it was published back in the era, it is. If I understand relevant US copyright laws correctly, the longest possible term would be 120 years for unpublished corporate works, which if applicable would give the photo another 2 years before PD status. I note that there was at least one other photo of Roosevelt at the same event, published at the time by Underwood & Underwood thus certainly PD-US; a copy can be seen at [1]; that would be a good substitute if this one needs (temporary for 2 years) deletion. -- Infrogmation of New Orleans (talk) 17:09, 16 July 2021 (UTC)
- Keep. Thanks for the link to the blog post, Infrogmation. Scrolling down about two thirds, there's a copy of this photo with the caption "the president speaking at Pomona College Friday morning", showing that it was published contemporaneously in the newspaper.
