The licence is incorrect, since this photo is not a "part of a statute, ordinance, official decree or judgment". Even if it had been taken for the government (and we don't know) it would not have make it free according to the German law. And since it has rather been taken in the 20th century (about 1939 as stated in the description) it could be not considered PD-old. Shaqspeare (talk) 07:43, 28 August 2013 (UTC)[reply]

 Comment I think that was not a good idea. Bundesarchiv has donated all its free files to commons four years ago. The uploader gives no link to the Bundesarchiv copy. Why? I guess, because it's not a free file or it's not from the Bundesarchiv. 24.134.38.224 08:26, 29 August 2013 (UTC)[reply]
 Comment This photo can not be considered anonymous, as it regards to the German law. German work prior to July 1997 can be considered anonymous not always when the creator is not presently known, but only if he/she intentionally published his/her work anonymously and his/her identity has not been declared by him/herself or his/her legal succesors up to 70 years after his/her dead. See also Anonymes Werk on German Wikipedia. And even if the "Bundesarchiv" had donated it, I wonder how could it hold personal author's rights on that picture.
