Atomium is in Belgium and thus is not covered by FoP; this file is a derivative of a non-free object. Ymblanter (talk) 20:15, 16 January 2015 (UTC)
- Keep — This photo was taken in Austria, not Belgium. Austrian FoP permits photos of copyrighted works if the works are on permanent public display. —RP88 (talk) 21:10, 16 January 2015 (UTC)
- Yes, but the original is in Belgium. Sorry, Belgium law, derivative of a non-free object. Sir Statler (talk) 21:16, 16 January 2015 (UTC)
- FoP doesn't mean that the sculpture isn't copyrighted. It means that photos don't infringe the copyright. So as long as it meets the Austrian FoP requirements, I think it's OK. --ghouston (talk) 21:23, 16 January 2015 (UTC)
- OK in countries that respect FoP on sculptures at least. It's still unusable in Belgium (and the USA). --ghouston (talk) 21:32, 16 January 2015 (UTC)
- I think it's ok. I know it's not ok. FoP doesn't mean that the sculpture isn't copyrighted What do you mean? I don't understand you. A copy is a copy. Ghoustoni is right. Sir Statler (talk) 21:37, 16 January 2015 (UTC)
- Is it your argument that this outdoor model of the Atomium in Austria (at Minimundus park) was constructed without the permission of the Atomium's rights holder (SABAM/Atomium asbl)? That is a separate issue, see earlier DR at Commons:Deletion requests/File:Minimundus117.jpg (the file from which this image was cropped). It appears that the source photo of this photo of the Atomium model Minimundus was previously kept based on Austrian FoP and on the assumption that the owner of the Minimundus park (the charity Rettet das Kind), where the model is permanently installed, has obtained permission from the Atomium copyright holder. The more interesting question is what to do if the charity Rettet das Kind built their model without permission. A discussion of how FoP interacts with public works put on display without authorization of the copyright holder can be found at Commons:Village_pump/Copyright/Archive/2014/09#Does_FoP_washes_copyright_violations.3F —RP88 (talk) 21:46, 16 January 2015 (UTC)

- It means you can't photograph the original in Belgium (due to lack of local FoP laws) but it's perfectly valid to photograph the model/reproduction in a FoP-enabled country. Judging from the DR of the source image this should be speedy kept. --Denniss (talk) 21:49, 16 January 2015 (UTC)
Kept: as per Denniss, and previous discussion of the same case. Yann (talk) 21:55, 16 January 2015 (UTC)
