The White House website gives credit to Cheriss May, who is not a White House photographer or US government employee. In her interview with NBC Washington, she said it was not the First Lady’s official photo as that was yet to come. Ms. May posted on Instagram on January 29 saying that it was taken before the inauguration. I believe this is copyrighted and permission is needed from Ms. May... unless it’s another example like Melania Trump’s?

The White House copyright page says: Except where otherwise noted, third-party content on this site is licensed under a Creative Commons Attribution 3.0 License. Visitors to this website agree to grant a non-exclusive, irrevocable, royalty-free license to the rest of the world for their submissions to Whitehouse.gov under the Creative Commons Attribution 3.0 License. Since this seems not to be her official portrait, I will concur that the license is incorrect. However, I believe that because it was found on the White House website, that very likely means that this falls under a CC 3.0 license, which is still compatible with Wikimedia guidelines. So, I believe that we should merely just change the licensing, instead of deleting the image outright. The Image Editor (talk) 15:51, 25 March 2021 (UTC)[reply]

If Cheriss May is not an employee of the federal government, then the photo is third-party content released under the CC license.   •  Keep The photographer's website captions this photo as "Commissioned portrait of First Lady Dr. Jill Biden on the White House website", suggesting that the White House (website) has the ability to license it as they see fit.
