Equiterre files
[edit]Both files were added to en:Steven Guilbeault by an Équiterre rep with the caption "© Équiterre" which demonstrates that their CC-BY-SA-4.0 "own work" claim is incompatible with their claim of copyright. --Salvidrim! 22:59, 16 October 2018 (UTC)
- Delete. The uploader has insufficiently documented the copyright situation. The file "StevenFondGris 2018.png" is a professional-style photo. It has been published on the internet since at least January 2016. See for example this webpage. On that same website, we can see that the url of the large image hints that the photographer is Anderson Lima. This is confirmed on other websites, where the photo is credited to him, for example there. Indeed, Anderson Lima is one of the two photographers who own this professional studio. Of course, this type of photo is made to be used by the client and it was used by Steven Guilbeault for his public relations. It is possible that the photographer ceded some of his rights to his client (the subject Steven Guilbeault or the organization Équiterre). Often, the client can use the photo for his needs, but the photographer retains the copyright, and the rights sold to the client do not go as far as allowing the client to release the photo under a free license. The actual situation depends on what they wrote in their contract. To succeed in keeping this photo on Commons in the way apparently wished by the uploader, Commons must have evidence of two things. 1) A declaration from the photographer, by which Anderson Lima confirms that he has ceded sufficient rights to Équiterre for Équiterre to release the photo under a free license. 2) A declaration from a verifiably authorized representative of Équiterre, confirming that Équiterre releases this photo under the chosen free license (or that Équiterre mandates officially the Commons user to release its rights). The file "StevenGroupeJeunesse 2018.png" is an amateur photo, probably taken by a friend of the pictured persons. The requirements are basically the same. The photographer should be identified (unlees he refuses to be identified publicly, in which case he should be identified privately through OTRS) and he must declare that he releases the photo, or that he was taking the photo in the course of his duties as a regualr employee of Équiterre, or that he has ceded sufficient rights to Équiterre, in which case Équiterre must declare that it releases the photo. -- Asclepias (talk) 01:21, 1 November 2018 (UTC)
