• the images are old enough to be in the public domain;
• the images are simple enough to satisfy the requirements of the {{PD-textlogo}} tag;
• the images are de minimis, for example, they are in the background and are not the focus of a photograph; or
• you are the copyright holder of a particular banner and agree to license, or you have obtained confirmation from the copyright holder that it agrees to license, the copyright in the images on the banner under a free licence, and evidence of such consent has been e-mailed to permissions-commons@wikimedia.org for OTRS verification.

All other photographs of banners should be uploaded to the Wikipedia project that you intend to use them in, and used under a fair-use justification if this is allowed. Not all Wikipedia projects permit the use of images under fair-use justifications. For the English Wikipedia, you must ensure that the non-free content criteria are satisfied.
