Licensing
[edit]Previous discussions
[edit]Previous discussion from Help Desk:
This image was considered as a featured picture (see Wikipedia:Wikipedia:Featured picture candidates/Japanese river boat). However, it failed because it had slightly contradictory licenses (attribution required and public domain). The original photograph is 100+ years old, but the uploader explains that the scanning and rendering of the photograph justifies attribution (see User_talk:Esby#File:Japon-1886-32.jpg). So, should it be attribution required or public domain? Mikael Häggström (talk) 06:53, 3 February 2009 (UTC) |

Coucou ! Jastrow (Λέγετε) 16:59, 30 January 2009 (UTC)
Well the main reason for my edits is that those images are not scans but photographs, so technically, after having read the guidelines on simple approximation, PD-old-100 should apply here. Now the images are not simple photographs but HDR photographs with custom tone mapping I adapted for each images to render the color in a realistic way. Now I (and we) don't know how the images looked initially 123 years ago. So technically the threshold of originality could be met to claim copyright, hence my initial dual licence gfdl + ccby. I also can't deny my partenity right of the french law, and can't technically release something to public domain. So I am given the following choices: Releases the images under PD template, while reminding that attribution must be respected, or restablish the original free dual licences, under the color originality. There is also another factor, there is not 1 images, but 49. So the same decision should be applied to all. Esby (talk) 18:13, 2 February 2009 (UTC) |

[edit]If the uploader doesn't want to release it to the public domain, then I think an attribution required license only, like {{CC-by-sa}} is better than it is now. Mikael Häggström (talk) 06:59, 3 February 2009 (UTC)
- the original licence I used was GFDL + CCBY. see https://secure.wikimedia.org/wikipedia/commons/w/index.php?title=File:Japon-1886-32.jpg&oldid=13250338 Esby (talk) 09:15, 3 February 2009 (UTC)
- I see it's Public Domain now. If there are no other changes that need to be tended immediately, I'd like to nominate it for featured picture again. Mikael Häggström (talk) 15:42, 8 February 2009 (UTC)
{{PD-France}} template
[edit]The idea settled in my mind for a while, and I think it's time to ask for an advise now, given the situation: would the creation of a {{PD-France}} template, explaining the stakes of the French laws on moral rights? →Diti the penguin — 11:06, 5 February 2009 (UTC)
Photographer
[edit]According to the descriptions in the book "Art & Artifice", p. 18 & 94 this picture shows a Pleasure boat on the Sumida River near Mukōkima, Tokyo (Mukōjima) and is one of Uchida Kuichi's "very excellent views", originally taken about 1872 and reissued by Kusakabe Kimbei about 1885. of course a hand-tinted albumen print. http://oldphoto.lb.nagasaki-u.ac.jp/en/target.php?id=2665 & http://oldphoto.lb.nagasaki-u.ac.jp/en/target.php?id=4583 without any photographer though --Catfisheye (talk) 23:34, 25 August 2010 (UTC)
