That's because there's another image with the same name at the English Wikipedia. Wikipedias always check for a file uploaded locally before checking at Commons. I made a request to rename the file at En. Wikipedia. Once the rename is done there, you'll able to use this image. -- Orionist ★ talk 18:15, 24 November 2010 (UTC)
