why is New Mexico not red. It was not retroactive and there are still 2 people. Also Vermont still has it for Treason. Why even is Delaware not red. Also, why is the lower peninsula of Virginia not red.

Well, the death penalty was just ruled unconstitutional in Delaware by the supreme court. So I guess that's true now. --130.245.194.146 01:34, 3 August 2016 (UTC)[reply]

What do you mean you "corrected" Delaware, or that it is "still legally retentionist"? .146 is correct. Delaware's death penalty statute was struck down as unconstitutional by its highest court. The situation is identical to New York, where the Court of Appeals in LaValle did not rule that the death penalty in the abstract was unconstitutional, but only the state's procedural statutes for imposing it, specifically regarding the jury's role. In neither case has the legislature amended the unconstitutional statutes, which are still in the codes. Until the legislature acts, there is no death penalty in Delaware. Does the Delaware Supreme Court held the statute contrary to the U.S. Constitution or to the Delaware Constitution (or both)? If you confirm with good source that it is one of the two last options, I will correct. But if the statute was held contrary only to the U.S. Constitution, the situation is not identical to NY, it is identical to Kansas in 2004, and thus we you should wait the U.S. Supreme Court ruling (or certiorari denial, or final decision by state autorities not to seek a certiorari).
