Despite being relieved of his official duties, British Resident James Busby continued to aid Hobson on his arrival. On 30 January, Busby circulated an invitation to each of the confederated chiefs to meet Hobson at Waitangi on 5 February. Busby also had a hand in the drafting of the Treaty. However there remains no perfect unanimity amongst scholars about the drafting process, which reinforces the complexity of the treaty’s history. Initially it seems that Hobson dictated a first draft of the treaty to his clerk, James Freeman while both were on board HMS Herald. Historians believe Hobson then penned a second draft preamble himself, although historians Anne Salmond and Phil Parkinson believed that this occurred later in the process. Hobson became too ill to leave the ship, and on 31 January had Cooper and Freeman deliver the prepared notes to Busby, along with a request for his view as to their suitability. Busby thought them inadequate – there was no land guarantee, for example – and, with the officials’ encouragement, he made some amendments. His main contribution was to Article 2. Busby resubmitted this draft to Hobson on either 3 or 4 February. This is a photograph of the original Treaty House, which was then the residence of James Busby. A number of important meetings between Hobson, Busby, missionaries, and others occurred here between his arrival and February 6, when te Tiriti o Waitangi was signed.
