e the far more serious step of putting it forward on oath,it is not easy to conceive. In common fairness to them, andin view of their youth, we must give them credit for sincerityand a belief that what they alleged to be true was true in sub-stance and in fact; and once this point is conceded, as it mustbe by every unbiassed student of the case, there remains onlyone reasonable explanation of their open and pronounced hos-tility to their half-brother, as of the false charges they formu-lated against him. They had been deceived by and were theunconscious tools of their mother, who, together with theiruncle and guardian, John Bird, sought, by playing upon theirinexperience, their self-interest, and their youthful credulity,to repair the one fatal omission of which their father hadbeen — perhaps intentionally—guilty between the making ofthe will and his decease. This conveyance the father had evidently forgottenwhen making his will; while, as for the four acres referredto above, that land was copyhold, holden of a certain Manor,and as such could change hands only in accordance with anancient custom, well recognised in law, known as surrenderto uses.
