Despite claims from several sources, it does not mention marriage or spouses, let alone explicitly excludes them. Arguably, 393 is all about marriage or at least includes marriage, especially as Article 394 is explicitly about rape/buggery 'outside of marriage', although it's also about underage people. Until better evidence comes...
