The reproduction of the National Seal of Mexico is prohibited outside official stationary and is certainly not in the public domain, see Article 6 of the National Seal, National Flag and National Anthem Law (in Spanish: "El Escudo Nacional sólo podrá figurar en los vehículos que use el Presidente de la República, en el papel de las dependencias de los Poderes Federales y Estatales, así como de las municipalidades, pero queda prohibido utilizarlo para documentos particulares. - Keep Of course is public domain, nobody but the Government of Mexico holds the moral rights of the National coat of arms. Furthermore, the Copyright Law (Ley Federal de Derechos de Autor) is very clear in its Article 14: No son objeto de la protección como derecho de autor a que se refiere esta Ley. - Dear friend, public domain does not stands for copyright ownership by a public institution or government, but for material that is "not eligible to copyright or for which the copyright has expired". As you clearly stated, the Mexican government is the owner of its moral rights (see Artículo 155.- El Estado Mexicano es el titular de los derechos morales sobre los símbolos patrios.). - Delete These guys are quite ignorant in the matter. There is a huge difference between a logo in the public domain and a logo that is not eligible for registration by a citizen or a private corporation at the Mexican Institute of Intellectual Property (IMPI). In this case, the Mexican government protects the intellectual property of the foreign organization or regional/national/foreign government automatically by rejecting spurious/unauthorized registrations of their IP. The article he quoted (no. 14, para. VII of the Federal Copyright Law) is rather explicit:
- Artículo 14.- No son objeto de la protección como derecho de autor a que se refiere esta Ley:" Las reproducciones o imitaciones, sin autorización, de escudos, banderas o emblemas de cualquier país, estado, municipio o división política equivalente, ni las denominaciones, siglas, símbolos o emblemas de organizaciones internacionales gubernamentales, no gubernamentales, o de cualquier otra organización reconocida oficialmente, así como la designación verbal de los mismos"
- In short, the article states that a reproduction without authorization of such images, etc. is ineligible for copyright protection, not that every single logo by a local/national/foreign organization/government is in the public domain!
