User:Scepia considers the image a copyvio, since it illustrates a copyrighted user interface - Mac OS X

I, user:.Koen do not think Scepia is right. The main subject of the image is the phone itself, not the UI. Besides, there are lots of other pictures of UI's. I would agree that a screenshot would be copyvio, but I do not consider a image with the UI loaded on the device as such. The author of the picture itself released the image under CC-BY-2.0, that shouldn't be a problem. .Koen 23:33, 17 January 2007 (UTC)[reply]
  • Delete, a major part of the image is the image of the copyrighted user interface (Mac OS X). One person may be looking at the overall view of the phone, but others are interested purely in the user interface aspect. Regardless of what the intention was, there is still a large portion of this image that is under copyright. Scepia 04:03, 19 January 2007 (UTC)[reply]

You can't really have a picture of the Apple iPhone without showing the software it is running. I would also point to Apple Computer, Inc. v. Microsoft Corp. --Midnightcomm 15:37, 22 January 2007 (UTC)[reply]

Yes, that is very true. However, we are talking about the image licensing, not how it is used in articles. The image is copyrighted. Scepia 22:48, 28 January 2007 (UTC)[reply]
