Possible copyright violation and COM:OVERWRITE & COM:SCOPE issues, with too weak evidence for permission available in the OTRS ticket and elsewhere. There are four versions of the file: Image 1 (2008), Image 2 (2012), Image 3 (2012) and Image 4 (2013). Only Image 1 has weak evidence at best for permission, one that is found outside of OTRS. The rest cannot be supported by the OTRS ticket because they were different images uploaded after ticket:2008080310001259 was accepted in 2008.
After ticket:2008080310001259 was accepted in 2008, I raised suspicion in the ticket in 2018 and had no response since then. The OTRS agent responsible appeared to have retired years ago. The "permission" in it sent in an email apparently from the uploader who claimed to have the permission of the original artists. We don't seem to have received any hard evidence to support the claim at OTRS.
Further details:
- Image 1: The artist's comment "無断転載加工等自由" ([These works are] free to redistribute, modify, etc) is something along the lines of {{Copyrighted free use}}, although the statement is not as clear as we want it to be. It does not mention commercial use.
- Image 2: Published circa 2003 without any license statement as far as I can see.
- Image 3: Duplicate of Image 1.
- Image 4: Apparently a newly created collage by the uploader combining four different images: Image 1 mentioned above, File:Adult Commons-tan.png, a work with a copyright statement by the uploader (on the top), and an unknown work (bottom-right). Overall, this file's copyright status is in a mess. It is likely to be out of scope, too, if the collage was done by the uploader and had no historical significance of its own. The uploader says "I have to recreate the atmosphere of the time in 2005", making it sound like it was his collage. The relevant artists were claimed to be "notified" [1], but we don't know what they had to say to the notifications.
Image 2 and 4 are particularly problematic in terms of copyright. It's likely that the two contain artworks that are not created by the uploader. As mentioned above, these were uploaded after the OTRS process, so even if the result of the OTRS process was valid, that won't extend to these images. It is not enough to notify the authors—we need explicit release statements from them.
To be clear, I'm not questioning the release of Category:Commons-tan (which is included in Image 4). The problem is about the other characters and artworks included in the collage/picture. whym (talk) 12:00, 12 December 2020 (UTC)
- Delete all. We have no ground to claim Image 2 and Image 4 were release under a free license. Image 1 and Image 3 might be debatable, but I'd recommend deletion.
