It looks like Bull-Doser, the original uploader, was most likely also the photographer, since it appears to have been taken with the same type of smartphone as his other uploads from that event (HTC Panache)- see here. It also shows his trademark quality problems, so I'd be surprised if it wasn't his.

(Disclaimer: I was notified of this deletion request only because I'd brightened the original upload in an attempt to improve the dull picture/lighting quality. However, I wasn't the original photographer or uploader, so I can't offer much meaningful input or opinion on any issues, legal or otherwise, surrounding this image). •  Comment @Josephine Simone: The photographer & uploader, User:Bull-Doser, has since been blocked for various problems including with Commons:Country specific consent requirements#Canada. Photo is currently in use, but I do not object to deletion. I wish to once again make the point that the best way for notable people to avoid having mediocre snapshots illustrating them in Wikipedia is to have a good quality photo (or photos) they approve of shared under a free license available for use. -- Infrogmation of New Orleans (talk)
