This is NOT a 'free' image, in addition the agency concerned (according to media reports) has apprently requested it's removal. This nomination is an attempt to put the debate in the appropriate on-wiki forum. Sfan00 IMG (talk) 09:46, 4 August 2010 (UTC)[reply]

This is NOT a free image , per notes on image description- ' but other restrictions apply. In the US, unauthorized use of the FBI seal, name, and initials are subject to prosecution under Federal Criminal law, including 18 U.S.C § 701, § 709, and § 712.' • Comment: Wikimedia General Counsel Mike Godwin discussed this with the nominator and others in IRC channel #wikimedia-commons. Quoting with permission: "The criminal statute has no bearing on whether it is free for Commons because the criminal statute does not create a property interest. It only forbids fraud. Non-fraudulent uses of the free (uncopyrighted) FBI seal are perfectly okay." (punctuation and capitalization added). NeilK (talk) 22:14, 13 September 2010 (UTC)[reply]
