Uploader is a paid editor for the subject (as disclosed at Wikipedia) so unlikely to be "own work". The image was probably provided by the subject or PR agency, who might be willing to release, but then we would need something transparent like an OTRS release.--Fuhghettaboutit (talk) 13:21, 10 November 2016 (UTC)
Hello https://commons.wikimedia.org/wiki/User:Fuhghettaboutit, Thankyou for the invitation to allow me to reply. I did in fact discuss the CC licence with Todd and asked for assignment of ownership and copyright which he agreed to - I expect to receive the written assignment of ownership and title this week Todd is in China and I am in the Philippines so that takes a few days. (I can get a soft copy of the assignment sent to me at some point today or this evening) Once I receive this should I submit the assignment to you or to the team at permissions-commons AT wikimedia DOT org?Neil Kindness (talk) 02:39, 11 November 2016 (UTC) I am trying to email commons but the address is invalid:
An error occurred while sending mail. The mail server responded: <permissions-commons@wikimedia.org?>: malformed address: ?> may not follow <permissions-commons@wikimedia.org.
Please check the message recipient "permissions-commons@wikimedia.org?" and try again
can you please help me - I have the written assignment of ownership and world copyright but cannot comply because your email address does not work.Neil Kindness (talk) 12:42, 11 November 2016 (UTC) Ah OK - I see the issue now - I have added "?" by errror to the address. let me try to resend the assignment03:55, 12 November 2016 (UTC) Ok - I have added pages to Todds site and uploaded images fo the work in question and his written assignment of ownership and copyright to me to try to assist in this matter:
image in question: http://toddanthonytyler.com/_MG_0305.jpg assignemt of copyright and ownership document: http://toddanthonytyler.com/copyright.jpg Todds email address for any verification that you may need: todd@toddanthonytyler.com
I hope the above helps a bit.Neil Kindness (talk) 04:12, 12 November 2016 (UTC)
Delete The photograph looks like a professional's work and if Mr. Tyler is depicted in the photo he cannot usually be the copyright holder. Owning a copy of his portrait does not automatically make him the copyright holder. Only the original photographer can assign his copyright to you, unless it was previously transferred to Tyler by agreement. If that was the case, we need a copy of this agreement too. - De728631Thankyou for taking time to address this issue. I note your concerns and have emailed Todd for clarification. I will post back here shortly.Neil Kindness (talk) 01:48, 14 November 2016 (UTC)
- @Neil Kindness: in case it wasn't clear, what we need now is documentation of how Mr. Tyler came to own the rights (e.g. a similar contract to the above, but transferring rights from the photographer to him). Storkk (talk) 09:42, 17 November 2016 (UTC)
