I have sent Mike Godwin some emails concerns this case and he said this

If Mike who is the Wikimedia's attorney says there is no problem about this I don't know why we should worry that much bout this.

Of course! You understand so much about copyright as him. Don't wonder why everybody complains about Commons, a project made by a bunch of amateurs with retrograde minds who do not want to make improvements to the project just for nothing. So stop saying I have come here to prove a POV and treat me like a dumb. I don't earn anything here contributing in this project either on Wikipedia or elsewhere. I do this because I like to share information and I do it respecting the projects policies. I often ask permission to use files, help solving someone troubles, marking copyvios to delete (even mine when I make a mistake) and translating policies and templates. I'm not here for trolling or do/upload whatever I want. I spent a lot of time reading Commons ploicies and clearing my doubts with some administrators like Lugusto and PatríciaR. I'm really aware of what is derivative work, freedom of panorama, licensing and so on. Of course I may forgot something or confusing. But what I'm trying to do here is that we have another excetion and we should analyze this case well. First of all I don't like Elmo and for me is the same thing this image keeps here or not. I just asked Mike's help to clear this doubt I had a long time ago and brought this here so we can brainstorm. I'm not ignoring Derivative Work policy and the time and trouble my pals had to accomplish it. But as a free project and made by amateurs we may have some mistakes and things we don't know. I think toys or other products like brasso, Toothpaste and the like, fall under Commons:Non-copyright restrictions following the reasoning that is expected the consumers use this product however they like and they have the rights to do so after they bought them. But still they are trademarked and would have some problems using them in some ways. Like Personality Rights. I may take a photo of Beyoncé, sell it, put it in a magazine and sell it. But I'd have some problems if I made a product and sell the photo in it as a Beyncé product. If I put a comic balloon saying nasty things I'l get another problem. The same Thing if I use L'oreal's logo to sell something and use would be another problem. Can you understand now?
