A nomination was previously opened with questionable motives and closed on those grounds. That notwithstanding, I believe there to be a genuine FOP issue and have elected to serve as a “proxy nominator”. This photo is a derivative work of the toy/figure (see Commons:DW#Casebook) and the mural (a not insignificant portion of the image and obviously an intended subject - not incidental inclusion). The mural may or may not be graffiti, but the figure seems unambiguous (removal thereof would leave only a blurry mural, which would thus be of questionable usefulness in articles, i.e. a COM:SCOPE issue).
