Even if you argue de minimis with regard to Apple's copyright, there's no arguing that Gizmodo's copyright has been clearly violated. Contrary to what Nard the Bard states, the CC-BY-NC "no commercial use" license used by Gizmodo is not acceptable on Commons - see Commons:Licensing for confirmation Little Professor (talk) 18:53, 8 February 2010 (UTC)[reply]
Actually, the image is licensed under a CC-BY-2.0 license, which is suitable for Commons. As stated on other iPad deletion debates, you don't know what financial arrangements Gizmodo has with the photographer.
